C. David Johnston

David serves as the head of our litigation practice, which includes a wide variety of general business litigation, including employment and labor litigation, intellectual property litigation, and the representation of primarily corporate clients either as plaintiff in collecting on contract claims or damage actions, including post judgment collection, or as defendant in defending similar actions. David's practice also includes general business and corporate representation of a broad range of entrepreneurial businesses, including legal entity formation of new and emerging businesses, assisting in the growth of the business through strategic legal planning, as well as developing succession and exit strategies for the entrepreneur. Prior to joining the Firm in 1984, David had five years of litigation experience with the U.S. Marine Corps, during which time he had a broad range of experience in both civil and criminal matters, including one year as a Military Judge. He then entered private law practice, spending four years with another Atlanta law firm gathering commercial litigation and extensive labor (management) experience.
Significant Representations
- Prosecuted an environmental pollution claim on behalf of a corporate client resulting in a settlement during Trial in which the polluter bought the client’s property for twice its cost
- Prosecuted the first case in a roll up dispute that became national in scope, resulting in our client being able to regain its business
- Successfully defending jury trials for our clients involving discrimination claims, such as national origin, race, sex and disability discrimination claims thoughout the US
- Successfully prosecuting and defending Non Solicitation provisions in clients Employment Agreements
- Sale of a $10.5M Plant to a European Corporation
- Sale of a client’s business for $47.5M after assisting the client in expanding and growing the business over 15 years
